876IX LOGISTICS – TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern all air freight forwarding and transit services provided by 876IX LOGISTICS ("Company", "we", "our", "us") to the customer ("Shipper", "Consignee", "Customer", "you"). By booking a shipment, transferring cargo to us, or utilizing our services, you agree to be bound by these Terms.
1. Scope of Services & Operational Focus
Primary Focus: 876IX LOGISTICS operates primarily as an air freight logistics provider.
Transit Only: Our services are strictly limited to the receipt, customs clearance, and direct transit/delivery of cargo.
No Warehousing: We do not offer long-term storage, warehousing, or inventory fulfillment services. All cargo must be collected or scheduled for delivery immediately upon customs release.
2. Payment Terms (Strict Upfront Policy)
Upfront Payment Required: Full payment of all freight charges, customs duties, taxes, clearance fees, and handling fees must be paid upfront and in full prior to delivery or release of the cargo.
No Credit/COD: We do not offer post-delivery billing, cash on delivery (COD) for freight charges, or extended credit terms.
Lien on Goods: 876IX LOGISTICS retains a general and absolute possessory lien on all cargo for any unpaid amounts. If fees are not paid upfront, cargo will be held at the customer’s expense until full payment is cleared.
3. Customer Documentation and Warranties
The Customer warrants and guarantees that:
Accurate Invoicing: You must provide true, accurate, and complete commercial invoices for all imported goods to facilitate Jamaican customs processing.
Prohibited Cargo: The shipment does not contain any illegal substances, hazardous materials, flammable goods, weapons, ammunition, or items prohibited under Jamaican law or international aviation regulations.
Fines and Penalties: Any fines, storage penalties, or legal fees incurred due to false declarations, under-invoicing, or prohibited items will be billed entirely to the Customer.
4. Limitation of Liability
Standard Air Freight Limits: Our liability for any lost, damaged, or delayed cargo is strictly limited in accordance with the Warsaw Convention or the Montreal Convention, depending on the governing international flight regulations.
No Consequential Loss: 876IX LOGISTICS shall not be liable for any indirect, incidental, or consequential damages. This includes, but is not limited to, loss of business profits, income, utility, or market opportunities caused by flight delays or customs inspections.
Force Majeure: We are not liable for service failures or delays resulting from acts of God, severe weather, airline flight cancellations, labor strikes, war, pandemic restrictions, or regulatory customs delays.
5. Cargo Insurance
Insurance Exclusion: Standard freight rates do not include comprehensive cargo insurance.
Customer Responsibility: It is the sole responsibility of the Customer to purchase third-party marine/air cargo insurance to protect against high-value loss or damage during transit.
6. Unclaimed & Abandoned Cargo
Strict Pickup Window: Because we do not provide warehousing services, any cargo left uncollected or unpaid for more than 30 days after notification of arrival will be deemed legally abandoned.
Disposal & Auction: 876IX LOGISTICS reserves the right to auction, sell, or dispose of abandoned cargo to recover outstanding freight, customs duties, and handling costs, in compliance with Jamaican law.
7. Claims and Notification
Inspection Upon Receipt: Any visible damage or shortage must be noted immediately at the time of delivery or pickup.
Written Claim Window: Formal written claims for hidden damage or loss must be submitted to 876IX LOGISTICS within 7 days of delivery. Failure to do so waives the right to a claim.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by, interpreted, and enforced in accordance with the laws of Jamaica. Any legal disputes, claims, or proceedings arising out of our services must be brought exclusively before the courts of Jamaica.
